#4 Do I have a personal injury claim?

Injured? Start Here, Personal Injury Claims

QUESTION: Do I have a personal injury case?

ANSWER: Whether you have a personal injury case depends on proving negligence—like in car accidents where another driver’s failure to act reasonably caused the collision. For premises liability claims, it involves showing a dangerous condition on a property that the owner knew about but didn’t address. Consulting with a personal injury attorney can help clarify if you have a claim by providing a no-fee, no-obligation case evaluation. Remember, most personal injury lawyers work on a contingency fee basis, meaning you only pay if they secure a settlement.

Do I have a personal injury claim?

This is the question we’re asked most often.

Not all of them, but most personal injury claims are due to a car accident.

To have a claim against the person who caused the collision, you legally have to prove that they failed to drive the way a reasonable person would have driven, under the circumstances.

For example, reasonable drivers don’t run red lights, they don’t run stop signs, and they don’t go forty miles an hour in a twenty-mile-an-hour speed zone. It is also the responsibility of all drivers to pay attention to what is going on around them and yield the right away to pedestrians.

If you have been involved in an auto accident that you believe was the other driver’s fault, it’s a good idea to get experienced legal advice.

Whether you decide to hire an attorney or not, talking with a lawyer will help you understand the personal injury claims process and advise you on the next steps to protect you and your claim.

If your injury happened on someone’s property, that is open to the public, such as a grocery store, a retail shop, or a sidewalk, proving negligence is very different. These types of claims are often called, “premises liability claims” or “unsafe property claims.”

To hold the owner of the property responsible for your injuries there are three things you have to prove.

First, was there a dangerous condition that caused you to be injured? Second, did anyone who works for the business or is responsible for the property know about the dangerous condition? Third, did they fix the dangerous condition or provide a warning about it?

If you have questions or concerns as to whether you have a claim, talk to a personal injury attorney. This type of lawyer works on a contingency fee basis and provides a no-fee, no-obligation initial consultation and case evaluation. It’s also important to note that if you do decide to hire a lawyer and they don’t negotiate a settlement on your behalf with the insurance company, you don’t owe a fee.
